3. Scope of the Terms and Conditions and applicable legislation
These Terms and Conditions apply to all electronic commerce services and sales contracts concluded through the litkeyart.hu Online Store. The language of the Contract is Hungarian. The concluded Contract is considered to be a written contract, which the Service Provider files electronically and retains for five years following its conclusion.
The Contract is governed by Hungarian law, primarily by the provisions of the following legislation:
- Act V of 2013 on the Civil Code;
- Act CLV of 1997 on Consumer Protection;
- Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services;
- Government Decree 45/2014 (II. 26.) on the detailed rules governing contracts between consumers and businesses;
- Decree 19/2014 (IV. 29.) of the Minister for National Economy on the procedural rules for handling warranty and guarantee claims relating to goods sold under contracts between consumers and businesses;
- Regulation (EU) 2016/679 of the European Parliament and of the Council, known as the General Data Protection Regulation, and Act CXII of 2011 on Informational Self-Determination and Freedom of Information in relation to data protection.
4. Ordering process and conclusion of the Contract
The Consumer places the selected Product or Products in the shopping cart. After providing the information required to finalise the order, including billing and delivery details, contact information and payment method, the Consumer submits an offer entailing an obligation to pay by clicking the “Place order” button or an equivalent button.
The Service Provider confirms receipt of the order electronically by email without delay, but no later than within 48 hours. If the confirmation is not received by the Consumer within this period, the Consumer is released from the obligation arising from the offer and the Contract is not concluded. The Contract is concluded when the confirmation is received by the Consumer.
The Service Provider does not distinguish between Consumers and customers who do not qualify as consumers, such as businesses, during the ordering process. However, the Service Provider draws attention to the fact that the provisions of these Terms and Conditions concerning consumer rights, particularly the right of withdrawal, apply exclusively to customers who qualify as consumers under the Civil Code.
Registration is not mandatory when placing an order. The Consumer may place an order as a guest without registering.
5. Products and prices
The prices displayed in the Online Store are gross prices stated in Hungarian forints. The Service Provider is exempt from value-added tax; therefore, the prices do not include value-added tax. Prices do not include delivery charges, which are displayed on the shopping-cart summary page before the order is finalised.
The Service Provider reserves the right to change the prices displayed in the Online Store. Any change will not affect orders that have already been placed and confirmed. If, despite the Service Provider’s best efforts, an incorrect price is displayed, particularly an obviously incorrect price that differs significantly from the generally accepted price of the Product, including a price of HUF 0 or HUF 1 displayed because of a system error, the Service Provider is not obliged to supply the Product at the incorrect price. The Service Provider may instead offer to supply it at the correct price, in which case the Consumer may withdraw their intention to purchase.
As the Products are handmade, they may have unique characteristics, such as variations in the pattern, wear or colour shade of the sailing rope used, and may differ slightly from the Product shown in the photographs. Such differences do not constitute defective performance.
6. Payment terms
The purchase price may only be paid online by bank card through the payment system operated by Barion Payment Zrt. (hereinafter: Barion). Payment is processed through Barion’s secure payment interface, and the Consumer’s bank card details are not disclosed to the Service Provider.
Payments made through Barion are governed by Barion’s General Terms and Conditions in effect at the relevant time, available at the following link: Barion General Terms and Conditions.
The purchase price is considered paid when it is credited to the Service Provider’s Barion account or confirmed as credited by Barion. The Service Provider begins preparing and packaging the Product after receiving the purchase price and confirming the order.
Online card payments are processed through the Barion system. Card details never reach the merchant. Barion Payment Zrt., the service provider, is an institution supervised by the National Bank of Hungary, license number: H-EN-I-1064/2013.

The total amount displayed on the order-summary page must also correspond with the amount actually charged at the time of payment.
8. Right of withdrawal without giving a reason within 14 days
Pursuant to Section 20 of Government Decree 45/2014 (II. 26.), the Consumer has the right to withdraw from the Contract without giving a reason. The withdrawal period expires:
- in the case of a contract for the sale of a product, 14 (fourteen) days after the date on which the Consumer or a third party designated by the Consumer, other than the carrier, takes possession of the Product;
- in the case of an order comprising multiple products, 14 (fourteen) days after the date on which the last Product is received.
The Consumer may also exercise the right of withdrawal during the period between the date on which the Contract is concluded and the date on which the Product is received.
Exercising the right of withdrawal: The Consumer must send an unambiguous statement expressing their intention to withdraw electronically by email to one of the contact addresses specified in Section 1 of these Terms and Conditions. The Consumer exercises the right of withdrawal within the applicable period if the withdrawal statement is sent before the period specified above expires.
Effects of withdrawal: If the Consumer withdraws from the Contract, the Service Provider will reimburse the full amount paid by the Consumer as consideration, excluding the delivery charge, without undue delay and no later than 14 days after being informed of the withdrawal. The Service Provider will use the same payment method used for the original transaction, namely Barion, unless the Consumer requests another payment method.
The Service Provider may withhold reimbursement until the Product has been returned or the Consumer has provided credible evidence that it has been sent back, whichever occurs first.
The Consumer must return the Product or hand it over to the Service Provider or a person authorised by the Service Provider to receive it without undue delay and no later than 14 days after communicating the withdrawal. The deadline is met if the Consumer sends the Product before the 14-day period expires. The Consumer bears the direct cost of returning the Product, and this cost will not be covered by the Service Provider.
The Consumer may only be held liable for any diminished value of the Product resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the Product.
Exceptions to the right of withdrawal: Pursuant to Section 29 of Government Decree 45/2014 (II. 26.), the Consumer may not exercise the right of withdrawal in relation to, among other things, a sealed Product that cannot be returned for health-protection or hygiene reasons once its packaging has been opened after delivery, or a non-prefabricated Product manufactured according to the Consumer’s instructions or explicit request, or a Product clearly personalised for the Consumer, such as a Product made specifically to an individual size or request. Where a Product is exempt from the right of withdrawal, the Service Provider will indicate this on the relevant Product page.

9. Warranty for lack of conformity, product warranty and guarantee
9.1 Warranty for lack of conformity
In the event of defective performance by the Service Provider, the Consumer may assert a warranty claim against the Service Provider in accordance with the provisions of the Civil Code. At the Consumer’s discretion, the Consumer may request repair or replacement unless the chosen remedy is impossible or would result in disproportionate additional costs for the Service Provider compared with another available remedy. If the Consumer did not or could not request repair or replacement, the Consumer may request a proportionate reduction in the price, repair the defect or have it repaired at the Service Provider’s expense, or withdraw from the Contract.
The Consumer may switch from the chosen warranty remedy to another remedy. The Consumer must pay any costs incurred by the switch unless the Service Provider caused the need to switch or the switch was otherwise justified.
The Consumer must notify the Service Provider of the defect without delay after discovering it, but no later than two months after the date of discovery. The Consumer may no longer enforce warranty rights after the two-month limitation period calculated from the performance of the Contract has expired.
Within two months of performance, there are no conditions for enforcing a warranty claim other than notifying the Service Provider of the defect. After two months have elapsed following performance, however, the Consumer must prove that the defect already existed at the time of performance.
9.2 Product warranty
If the Product is defective, the Consumer may choose to assert either a warranty claim for lack of conformity or a product-warranty claim. Under a product-warranty claim, the Consumer may only request the repair or replacement of the defective Product. A Product is defective if it does not meet the quality requirements in effect when it was placed on the market or does not possess the characteristics stated in the manufacturer’s description. A product-warranty claim may be asserted within one year after the Product was placed on the market. The manufacturer, in this case the Service Provider, is released from liability if it proves that the defect could not have been detected based on the state of scientific and technical knowledge or that the defect resulted from the application of a statutory or regulatory requirement.
9.3 Guarantee
In view of their nature, the Products are not currently subject to a mandatory statutory guarantee.
10. Complaints and enforcement options
The Consumer may submit a complaint concerning a Product or the Service Provider’s activities using the contact details specified in Section 1 of these Terms and Conditions, primarily by email at litkeybotond@gmail.com. The Service Provider will examine an oral complaint immediately and, where possible, remedy it immediately. The Service Provider will respond to a written complaint in writing within 30 days of receipt.
If the complaint cannot be resolved, the Consumer may use the following enforcement options:
- initiate proceedings before the competent district office acting as the consumer-protection authority;
- initiate proceedings before the competent conciliation board according to the Consumer’s permanent or temporary place of residence or, in the absence of either, according to the Service Provider’s registered office. The competent body according to the Service Provider’s registered office is the Budapest Conciliation Board, 1016 Budapest, Krisztina krt. 99., bekeltet.bkik.hu;
- initiate court proceedings.
Consumers residing in the European Union may also submit complaints through the European Commission’s dispute-resolution platform: European Commission online dispute-resolution platform.
11. Data processing
The Service Provider processes the personal data provided by the Consumer for the purposes of fulfilling orders; concluding, defining and amending the Contract; monitoring its performance; invoicing the resulting charges; enforcing related claims; and complying with statutory obligations. Detailed rules concerning data processing are contained in the separately available Privacy Policy, which was prepared in accordance with the General Data Protection Regulation and Act CXII of 2011 on Informational Self-Determination and Freedom of Information.
12. Miscellaneous and final provisions
Matters not regulated by these Terms and Conditions and the interpretation of these Terms and Conditions are governed by Hungarian law, particularly the provisions of the Civil Code, Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services, and Government Decree 45/2014 (II. 26.). The mandatory provisions of the applicable legislation apply to the parties without any separate stipulation.
The Service Provider is entitled to amend these Terms and Conditions unilaterally. An amendment enters into force when published in the Online Store and does not apply to orders placed before its effective date.
If any provision of these Terms and Conditions is found to be invalid, this will not affect the validity of the remaining provisions.
